Texas Consumer Protection

There are several areas of Texas state law that help protect Texas consumers from a variety of abuses. Here are some of the main areas covered. If you feel you might be the victim of a fraud in one of these areas, please call us at (254) 840-0220 for a free initial consultation.

Debt Collection Act/Fair Debt Collection Practices

The Debt Collection Act and Fair Debt Collection Pracices act prohibits debt collectors from using fraud, threats or coersion against the consumer. If you are being harrassed by debt collectors, call us and we may be able to give you relief without your having to declare bankruptcy.

Deceptive Trade Practices Act (DTPA)

The Deceptive Trade Practices Act (DTPA) is the primary statute protecting Texas's consumers from a variety of wrongs. The statute details a list of trade practices that might mislead or deceive consumers. It gives consumers the right to sue for damages. Consumers who win a suit brought under the Deceptive Trade Practices Act are entitled to damages and attorney's fees, and if they show the person acted "knowingly," they can receive triple damages.

Some of the areas that the DTPA covers include:

  • Timeshares
  • Contests and Gift Giveaways
  • Business Opportunities
  • Health Spas
  • Telephone Solicitations
  • Consumer Reporting Agencies
  • Credit Services Organizations
  • Any violation of State and/or Federal Fair Debt Collection Acts.

Texas Insurance Code

Similar to the Deceptive Trade Practices Act, the Insurance Code prohibits false, deceptive and misleading acts and practices. People who are injured by a violation of this law may recover damages, possible treble damages, as well as attorneys' fees.

Landlord/Tenant Consumer Protection

The Landlord and Tenant provisions of the Texas Property Code provide consumers protections against wrongful refusal to return security deposits, utility cutoffs, retaliatory evictions, landlord repairs, and other abusive practices.

Discrimination in Housing

The Texas Fair Housing Act protects consumers in the housing market from unlawful discrimination.
